“We”, “us” and “our” mean ADMOX. “You” means the person playing. “Terrazzo” or “the game” means the Terrazzo app, its updates, its worlds and its online features (boards, player cards and friends).

1. What these terms cover

1.1 These terms are the licence for the game and the rules for its online features. You accept them by downloading or playing Terrazzo. If you don’t accept them, please don’t play.

1.2 You get Terrazzo, and buy anything in it, from the App Store. Apple is the seller: your purchase, its payment, its tax and its receipt are between you and Apple, under Apple’s own terms. Section 15 adds the terms Apple asks every app to include.

1.3 How we handle your data is in the privacy policy.

2. Your licence

2.1 We give you a personal, non-exclusive, non-transferable licence to play Terrazzo on the devices you own or control that the App Store allows, including the devices in your Family Sharing group where the App Store offers it.

2.2 Terrazzo is licensed, not sold. That goes for the worlds you buy, too: you get the right to use them in the game, not ownership of the game or its art.

3. Worlds and other things you buy

3.1 Terrazzo is free to play. Some worlds, and bundles of them, can be bought in the game; others are earned by playing. The shop says before you buy what each one includes, including whether it turns off the ads.

3.2 What you buy is tied to your App Store account. If you change phones or reinstall, Restore purchases in Settings brings it back.

3.3 Purchases have no value outside the game and can’t be exchanged for money or moved to someone else’s account.

3.4 We may change prices, and we may add, change or retire worlds or offers for future purchases. A world you have already bought stays yours for as long as the game runs on your device.

4. Refunds

4.1 Because Apple is the seller, refunds for App Store purchases are handled by Apple under its own policy, at reportaproblem.apple.com. We can’t issue them ourselves.

4.2 If something you bought doesn’t work, write to us first: we would rather fix it. Your statutory rights in section 12 apply as well.

5. Boards, player names and friends

5.1 The boards show the name you pick, your emblem and title, and your scores, to other players. Pick a name you are happy for anyone to see.

5.2 Names must not be offensive, hateful or sexual, impersonate someone else, or carry advertising or links. We may rename a player, hide a name or remove a score that breaks this, without notice.

5.3 Scores must come from playing. If a score was made by cheating, modified software or automation, we may remove it, and we may keep that player off the boards.

5.4 Friend codes are for sharing with people you know. Adding a friend shows each of you the other’s card.

6. What you may not do

You may not, and may not let anyone else:

  • copy, sell, rent, lend or redistribute the game or its art, music or puzzles;
  • work around the game’s purchases, or interfere with its server or anyone else’s use of it;
  • cheat on the boards, for example with modified builds, scripts, bots or faked results;
  • reverse engineer, decompile or disassemble the game, except where the law lets you;
  • remove copyright or trademark notices; or
  • use the game in a way that breaks the law that applies to you.

7. The game, its updates and its online features

7.1 We keep improving Terrazzo, so worlds, puzzles, seasons and features change over time. We are not obliged to release any particular update or feature. Where EU law requires updates to keep the game working as described, we provide them; see section 12.

7.2 Puzzles, worlds and your progress work without an internet connection. The boards, player cards and friends need one, and depend on our server being up.

7.3 If we ever close the online features, we will say so in the game and on this website at least 30 days before. The rest of the game, and the worlds you bought, keep working on your device.

8. What you can expect from the game

8.1 We make Terrazzo with reasonable care and skill, and it does substantially what its store page and this website say it does.

8.2 To the extent the law allows, and apart from your statutory rights in section 12, the game is provided as it is, without any other promise: we don’t guarantee it will be free of bugs, always available online, or suited to a purpose we don’t know about.

9. Our liability

9.1 We are liable for loss we cause by breaking these terms or by failing to use reasonable care and skill, but not for loss that wasn’t foreseeable.

9.2 To the extent the law allows, we are not liable for indirect or consequential loss, or for lost progress you could have restored.

9.3 To the extent the law allows, our total liability to you is limited to what you paid for purchases in Terrazzo in the twelve months before the claim.

9.4 Nothing here limits liability for death or personal injury caused by negligence, for fraud, for damage caused intentionally or by gross negligence, or for anything else the law doesn’t allow us to limit. If you are a consumer, sections 9.1 to 9.3 apply only as far as Czech and EU consumer law permits.

10. Intellectual property

10.1 Terrazzo, its puzzles, worlds, art, music, sounds, name and logo, and the Incregames name and logo, belong to us or our licensors and are protected by copyright and other laws.

10.2 App Store, iPhone and Game Center are trademarks of Apple Inc. Other names belong to their owners.

11. Ending these terms

11.1 You can stop at any time by deleting the game. To have your player removed from our server too, see section 11 of the privacy policy.

11.2 We may end your licence, or keep you off the boards, if you seriously break these terms, in particular sections 5 and 6. Where the problem can be put right, we will give you a fair chance to do that first.

12. Your rights as a consumer

12.1 If you are a consumer, you have rights under Czech and EU law that these terms cannot reduce. Where these terms conflict with them, those rights win.

12.2 Under the EU rules on digital content (Directive (EU) 2019/770, part of the Czech Civil Code) you are entitled to a game, and to worlds, that work as described, and to a remedy if they don’t: a fix, a price reduction or a refund.

12.3 EU consumers normally have 14 days to withdraw from a purchase made at a distance. For digital content delivered at once, that right ends when delivery starts, if you asked for immediate delivery and accepted losing it; the App Store asks for that when you buy.

13. Governing law and disputes

13.1 These terms are governed by the law of the Czech Republic.

13.2 If you are a consumer living in another EU or EEA country, you keep the protection of your own country’s mandatory consumer law, and you may bring proceedings in your own country’s courts. Otherwise, the courts of the Czech Republic decide.

13.3 Czech consumers may take a dispute to the Czech Trade Inspection Authority (Česká obchodní inspekce, coi.cz). Questions about a payment, a receipt or tax go to Apple first, as the seller.

14. Other terms

14.1 We may update these terms, for example when the game gains new features. The date at the top changes when we do, and material changes are announced in the game. If you keep playing after a change takes effect, the new terms apply.

14.2 If part of these terms turns out to be unenforceable, the rest stays in force. If we don’t enforce something straight away, we can still enforce it later.

14.3 We may transfer these terms to someone who takes over the game; your rights stay the same.

14.4 The English version is the one that counts. A translation is for convenience only.

15. If you got Terrazzo from the App Store

Apple asks every app with its own terms to include these points:

  • These terms are between you and us, not Apple. We, not Apple, are responsible for the game and its content.
  • Your licence is to use the game on Apple-branded devices you own or control, as the App Store’s Usage Rules allow.
  • Apple has no obligation to provide maintenance or support for the game.
  • If the game fails to meet a warranty that applies to it, you may tell Apple, and Apple will refund the purchase price, if any; Apple has no other warranty obligation for the game.
  • We, not Apple, handle any claim about the game, including product liability claims, claims that it fails to meet a legal or regulatory requirement, and consumer-protection claims.
  • If someone claims the game infringes their intellectual property, we, not Apple, handle that claim.
  • You confirm you are not located in a country under a US government embargo or designated as a “terrorist supporting” country, and are not on a US government list of prohibited or restricted parties.
  • Apple and its subsidiaries are third-party beneficiaries of these terms and may enforce them against you.
